1. Who these terms apply to
These terms govern use of the Liquidsend platform, operated by African Luxury Group Limited (“we”, “us”, “Liquidsend”), located at 45 Albemarle Street, London W1S 4JL, United Kingdom.
By creating an account or installing our app from the Shopify App Store, you agree to these terms on behalf of yourself or the entity you represent.
2. What Liquidsend provides
A subscription-funnel application that lets you send WhatsApp and email messages to your customers, manage subscription state, and track conversion. We connect to your existing payment provider (Stripe, PayPal, Recharge) or your Shopify store; we don’t process payments ourselves.
3. Your responsibilities
- Obtain valid opt-in from every customer before sending them WhatsApp messages or marketing emails.
- Comply with WhatsApp’s Business Messaging Policy and Meta’s Terms.
- Comply with applicable consumer-protection law (UK Consumer Rights Act, EU Consumer Rights Directive, US CAN-SPAM where applicable).
- Honor opt-out requests promptly. Liquidsend automates this where possible (Reply STOP triggers suppression) but ultimate compliance is yours.
- Keep your account credentials secure. You are responsible for activity on your account.
4. Pricing and billing
Liquidsend pricing is shown on the website at the time of signup or upgrade. Charges recur monthly via the payment method on file. Failed renewals may result in service suspension after 7 days. Refunds are at our discretion and considered case-by-case.
Third-party costs (Meta WhatsApp message fees, Stripe processing fees, etc.) are billed directly by those providers — Liquidsend doesn’t mark them up.
5. Acceptable use
You agree not to use Liquidsend to:
- Send unsolicited messages to people who haven’t opted in.
- Send content that violates Meta’s WhatsApp Commerce Policy or Business Messaging Policy.
- Distribute malware, phishing links, or fraudulent content.
- Reverse-engineer the platform or attempt unauthorized access.
- Resell access to Liquidsend without a separate written agreement.
Violations may result in account suspension or termination without refund.
6. Data ownership
You own your customer data. We process it on your behalf as a Data Processor under UK GDPR. On account closure we’ll export your data to you on request, then delete our copies within 30 days (subject to statutory retention noted in our Privacy Policy).
7. Service availability
We aim for 99.5% uptime but make no guarantees. The service may be unavailable during planned maintenance, third-party outages (Meta, Stripe, Shopify, Supabase), or unforeseen incidents. We’ll communicate planned maintenance in advance via the merchant dashboard.
8. Limitation of liability
To the maximum extent permitted by law, Liquidsend’s total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or revenue.
9. Termination
You can cancel anytime via the merchant dashboard. We may terminate your account for breach of these terms with 14 days notice (or immediately for severe violations). On termination you’ll have 30 days to export your data before deletion.
10. Governing law
These terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to terms
We may update these terms with 30 days notice via the merchant dashboard. Continued use after the effective date constitutes acceptance.
